2. Definitions

  • “We”, “Us”, “Our”: Refers to Bunobair.
  • “You”, “Your”: Refers to the client or worker using our services.
  • “Services”: Refers to payroll processing, labour supply, recruitment, and other related services provided by Bunobair.
  • “Contractor”: Refers to individuals engaged under the Construction Industry Scheme (CIS), Umbrella payroll, or PAYE services.
  • “Client”: Refers to businesses engaging Bunobair for payroll or labour supply solutions.

3. Services Provided
3.1 Payroll Services: We provide payroll management for PAYE, Umbrella, and CIS workers, ensuring compliance with HMRC regulations.

3.2 Labour Supply: We source and supply skilled workers for temporary, contract, or permanent roles based on the client’s requirements.

3.3 Compliance: We ensure all workers meet HMRC requirements, including SDC tests for CIS contractors, right-to-work verification, and adherence to relevant legislation such as IR35, MSC, and AWR.


4. Client Obligations
4.1 Accurate Information: You must provide complete and accurate information required for payroll processing, including employee details, hours worked, and tax codes.

4.2 Compliance: You agree to adhere to all relevant employment laws and HMRC regulations when engaging our services.

4.3 Payments: All invoices issued by Bunobair must be paid within the agreed terms to avoid disruptions to services.


5. Worker Obligations
5.1 Registration: Workers must complete the registration process, including providing proof of identity, address, and any other required documentation.

5.2 Compliance: Workers must update us with any changes to their employment status or personal details.

5.3 Accuracy: Workers are responsible for submitting accurate timesheets and expense claims in a timely manner.


6. Fees and Payment
6.1 Service Fees: Fees for payroll services and labour supply will be detailed in your agreement. A maximum charge of £20 per week applies to workers for payroll services.

6.2 Non-Working Periods: Workers will not be charged for weeks when no work is undertaken.

6.3 Refunds: No refunds will be issued for services already rendered unless otherwise agreed in writing.


7. Liability
7.1 Accuracy of Information: We are not liable for errors arising from incorrect or incomplete information provided by you.

7.2 Service Disruption: While we aim to provide uninterrupted services, we are not liable for delays or disruptions caused by factors beyond our control, including technical failures or regulatory changes.

7.3 Worker Engagement: We act as an intermediary and are not responsible for disputes between clients and workers.


8. Data Protection
We are committed to protecting your personal data in compliance with UK GDPR and the Data Protection Act 2018. Please refer to our Privacy Notice for details on how we collect, use, and store your information.


9. Termination
9.1 Termination by You: You may terminate your agreement with us by providing written notice as specified in your contract.

9.2 Termination by Us: We reserve the right to terminate services if you breach these Terms or fail to meet payment obligations.


10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
